California Bankruptcy Attorney Reveals The Truths About Chapter 7 ...

Chapter 7 is the smallest, easiest and least expensive type and has the following general characteristics: The total pendency (or duration) of an uncontested Chapter 7 Bankruptcy case is about 5 or 6 months (which in legal terms is very fast). The Bankruptcy Court?s filing fees are 9.00 A Chapter 7 Bankruptcy will discharge all debts that can be discharged almost immediately (the official discharge of creditors will not occur until the end of the case, but due to the immediate ?stay? that takes effect upon the filing of the petition, the effect to the client is, for the most part, that their debts are no longer an issue i.e., phone calls from creditors will cease, lawsuits, levies, garnishments, etc., all will stop). However, please note the following: All secured creditors (mortgages, car payments, lease or rent obligations) must be current if you want to keep the house, car, or stay in the premises. Some debts are not dischargeable i.e., spousal or child support arrears, some taxes, loans for tuitions, etc. Most credit card accounts will likely be closed, even if you are current with the payments and even if you have a zero balance. If you want to keep a credit card that has a zero balance, the best thing to do is to call the issuing card company and explain that you are going to file a Bankruptcy petition due to circumstances, but that you would like to keep that account. There is no law that compels a credit issuing entity to keep the account open or to close it but most credit issuing companies have a policy of simply closing the account. However, in some cases, a credit card account may survive the Bankruptcy. For the most part, after filing a Chapter 7 Bankruptcy, a cash and carry policy must usually be adopted while improving the financial situation and then re-establish credit gradually. Improving credit scores can easily be done but usually takes 2 ? 3 years. However, under the 2005 changes to the Bankruptcy Code, a debtor must now qualify for a Chapter 7. Basically, the way one qualifies for a Chapter 7 is by NOT having too much income as determined by a ?Means Test?. How much is too much, depends on the number of people, (whether they are close family members or not), anyone living in your house that you support. In some cases even if a person does not live in your house, i.e., aging or infirm parents, etc., can be considered supported for means test purposes. A Debtor?s income is based on their actual income for the past six months prior to the filing of the petition. It is then annualized for ?Means Test? purposes, (in other words, actual income received for the past six months? times two). An example of how this works is as follows: California debtors, husband and wife have 2 kids. The Means Maximum is approximately ,000. Husband has regular full time income of ,000. Wife is a school teacher that makes an annual income of ,000 for a combined annual total income of 0,000. However, Wife does not have income for the summer months that school is out. Debtors file their petition in November and Wife has only had income for three of the last six months totaling ,000. Husband?s income was steady for the last 6 months for a total of ,000. The actual income received by the two together total ,000. When annualized (times two) the total actual income for means test purposes is ,000. Qualifying the debtors at ,000 (only ,000 above the means threshold) is a lot easier than trying to qualify them at 0,000 (,000 above the limit). The ?Means Test? income thresholds vary depending on the number of persons you support in your household. These threshold maximums are based on IRS national standards and may be exceeded by substantial amounts for Debtors living in California because the Bankruptcy Court recognizes that some states are more expensive to live in than others, (i.e., state income tax rates, and costs of living), California being among the most expensive. If a debtor cannot qualify for a Chapter 7 under the means test, a petition under Chapter 13 will be the only means by which to seek protection from creditors and the debtor will be forced into a 5 year Chapter 13 plan. Furthermore, the ?Means Test? income threshold is only the first of three elements necessary to qualify for a Chapter 7 Bankruptcy. The other two include: Asset Values. If you have too many assets in categories that are not exempt, or if asset values exceed exemption limits, you may not qualify for a Chapter 7 discharge without the risk of losing those assets. For example; even though a Debtor may have limited income and qualifies under the ?Means Test?, if that Debtor has excessive equity in a home (over the homestead exemption amounts that range from ? 150K, depending on marital status, age, disability, etc.,), or other property of net value (equity), or un-exempt savings accounts, bonds, etc., the Bankruptcy Court may determine that the Debtor is not insolvent and therefore does not qualify for a Bankruptcy under Chapter 7 and must instead file a petition under Chapter 13 or 11. The monthly payments under a Chapter 13 would have to exceed the amount that creditors would receive if the assets were sold and the money paid to creditors. For example: debtor has severely diminished income due to a business failure but has 5K in equity in his home. After exempting 0,000 under the homestead exemption, there is 5,000 available to creditors. In order to keep the home under a 5 year Chapter 13 plan the debtor would have to pay about ,083.00 plus about 0 (Trustee?s administrative costs) per month to the Bankruptcy Trustee. Keep in mind that the monthly amount paid to the Trustee is in addition to the debtor?s then existing mortgage and regular monthly expenses. Excess Disposable Income. Even if a Debtor has no assets, and qualifies under the ?Means Test?, when a Debtor completes an income and expense sheet (expenses do not include credit card and any other dischargeable debts), if, after deducting ordinary expenses, rent or mortgage, utilities, groceries, out of pocket health care costs, fuel and auto maintenance expenses, etc., there remains too much money left over (referred to as disposable income), the Bankruptcy Court may determine that the Debtor is capable of servicing debts under Chapter 13 for the amount of that disposable income for a period of three years or until debt obligations are fulfilled, whichever comes first. For example: a client has K of credit card debt; K in medical bills; a repossession of her car and a bill for K on that repo for a total debt of ,000. She has a job earning per hour and has moved back to her parents? home. She pays no rent and only helps with groceries. After deducting her expenses including car maintenance, gas, and insurance, groceries, and other expenses, but NOT including her credit cards, medical bills, and the repo bill, she has disposable income of over ,200 per month. She will probably not qualify for a Chapter 7 Bankruptcy. Her options are to file a petition under Chapter 13 and make payments for 36 months at 00 (for a total of ,200). After making those payments for three years, the balance of unpaid debt will be discharged. Or, she could move out of her parents? house, rent an apartment for ,200 a month, and then file the Chapter 7 petition. Her income and expense sheet will then show less than 0 of disposable income and she will qualify for the Chapter 7, all her debts will be discharged without making any payments to creditors, and when the case closes 5 months later, she can move back in with her parents and begin to save money and get back on her feet. With respect to car payments, if you want to keep a car or cars that you are currently making payments on, you must reaffirm that contract. A reaffirmation tells the Bankruptcy Court and the creditor that you intend to retain the car and keep making the payments until the end of the lease period or until the finance contract is complete. There are three things you have to pay for in a Chapter 7 Bankruptcy. They are 1. Your attorney fees 2. The Bankruptcy Court?s filing fees and 3. Mandatory credit counseling courses. Except for the credit counseling courses, all fees must be paid in full before the actual?filing of the petition with the court. The reason for this is because in a Chapter 7 Bankruptcy, all dischargeable pre-petition debts must be discharged. Therefore if you owed your attorney money after the petition is filed, that debt would also be discharged. However, payment arrangements can be made prior to the filing of the petition. Mandatory Credit Counseling Courses are required in all Chapters of Bankruptcy. There are two credit counseling courses that must be completed. The first, called a Pre-Petition Credit Counseling Course, needs to be completed and a certificate?of completion submitted with the petition of Bankruptcy. The second is called a Post-Petition (sometimes called a Pre-Discharge) Financial Management Course should be completed within 45 days after the Petition is filed with the Bankruptcy Court. ?There are 3 ways you can take this course.? On Line?- Least expensive?and can be completed in about an hour. By telephone ? A little more in cost and takes about 45 minutes. Classroom setting ? Costs the most and is offered during the week and weekends from some credit counseling providers. After the petition is filed with the Bankruptcy Court under Chapter 7, there are only two things left for the debtor to do. They are: Complete the 2nd Credit Counseling Course (called the ?Post-Petition Financial Management Course? or sometimes called ?Pre-Discharge Financial Management Course?), and attend a hearing, called a 341 Creditors Meeting. At this hearing the debtors will be called to testify before the ?Panel Trustee?. There are about 8 to 10 or 12 ?Panel Trustees? that serve under the supervision of the U.S. Trustee for the Jurisdiction the debtor files in. These Panel Trustees make preliminary findings about the nature of the debtor?s financial circumstances. The Trustee will ?swear in? the debtor and ask the debtor to produce identification and their social security card. Each Trustee has their own little script of questions they routinely ask the debtor, who gives his or her answers under penalty of perjury. The questions usually concern whether the debtor has filed a bankruptcy before, whether the debtor is obligated to pay any kind of support (child support or spousal support), and if the contents of their most recent tax returns are true and correct. But some questions are asked by all the Trustees in every case. They include: Did you read your petition before you signed it, and is everything in the petition true and correct to your knowledge. That is about it. The questions usually take only about 3 or 4 minutes. The worst part about this hearing is just going there, finding a parking space, and then waiting your turn because you will there with about 20 or 30 other people on that hour?s calendar. After that, it?s all pretty much over. There is really nothing else to do. About 3 or 4 months later you will get a letter from the Bankruptcy Court telling you that the case is closed and the debts are discharged.

Having already pulled out of Brazil and shut down a research building in North Carolina, HTC has now closed its office in the South Korean capital of Seoul. The move is part of the Taiwanese manufacturer's efforts to "streamline operations" and focus on selling One-branded handsets in markets where it stands a better chance of success -- rather like Nokia's geographic retreats following its commitment to Windows Phone, but here on a much smaller scale. It's not yet clear how many jobs will be lost, but HTC says it regrets the "direct impact on people who have contributed to the growth HTC has experienced in the past several years." As it stands, analysts reckon that Korean manufacturers like Samsung, LG and Pantech rule a 90 percent share of their home market, leaving HTC with just one or two points that evidently weren't worth clinging onto.

Romney: US, Israel differences embolden enemies

Mitt Romney says any public differences between the United States and Israel only embolden adversaries.

The U.S. presidential candidate says it is a "basic truth" that the United States and Israel will always stand together.

Without mentioning the tensions between President Barack Obama and Israel's leaders, Romney suggested in a Jerusalem speech Sunday that the diplomatic differences only encourage Israel's enemies.

Obama has, at times, broken with Israel's leaders and called on Israel to follow through on its commitments, such as to halt building of housing settlements.

Romney says he would never criticize Israel and would be a steadfast ally to the Jewish state.

US: Religious freedom low in Afghanistan, Pakistan

WASHINGTON (AP) ? The U.S. is criticizing allies Afghanistan and Pakistan for poorly defending religious freedom.

A State Department report says Afghanistan's courts interpret Islamic law to punish non-Muslims for exercising their faith.

And it cites Pakistan for issuing death sentences for blasphemy. Despite increased extremist attacks on minorities or even tolerant Muslims there, it says, authorities have rarely investigated perpetrators.

Monday's report particularly highlights blasphemy and religious "defamation" laws.

The department lamented long prison sentences and lashings for people in Saudi Arabia charged with insulting the Muslim Prophet Muhammad.

Government efforts against "violent extremists" also came under scrutiny. The report says Bahraini, Russian, Iraqi and Nigerian authorities don't always distinguish terrorism from peaceful religious practice.

It also criticized chronic religious liberty violators China, North Korea, Iran and Eritrea.

ANN ARBOR: University of Michigan running back Fitzgerald Toussaint expected to be charged for drunken driving arrest

University of Michigan starting running back Fitzgerald Toussaint is expected to be charged sometime within the next two weeks from his drunken driving arrest on July 21.

Toussaint, 22, is currently suspended from playing as a result of the arrest.

The Saline Police Department arrested Toussaint at about 11:45 p.m. July 21 near downtown Ann Arbor, according to Saline police.

Detective Don Lupi said Saline officers were working on a special enforcement detail in Ann Arbor alongside other local police departments.

The high-visibility enforcement detail allowed arrests outside of the department's jurisdiction.

Saline officers observed Toussaint's vehicle, a white Ford F150, drive through a red light at the intersection of Washtenaw and South Forest avenues, according to the police report. His vehicle continued to travel northeast onto Observatory Street. Police followed and signaled him to stop.

The officer who made contact with the driver, who was identified as Toussaint, noticed the odor of alcohol from within the vehicle, according to the report.

During the roadside investigation it was determined he had possibly been driving under the influence based on field sobriety tests and a preliminary breath test that officers administered, Lupi said.

Toussaint was transported to the Saline Police Department where he took a chemical test showing a blood alcohol content level of 0.12 percent, which is above the legal limit of 0.08.

He was held until sober and released the morning of July 22. Continued...

The case against Toussaint has been forwarded to the Washtenaw County prosecutor's office for authorization of possible charges for operating under the influence, Lupi said.

Following the arrest, University of Michigan head football coach Brady Hoke released a statement saying Toussaint has been suspended because of the incident.

"Fitz made a poor decision and has been suspended indefinitely because of that action," Hoke said. "There are expectations that come with being a football student-athlete at the University of Michigan and those responsibilities were not met in this instance.

"We will use this as an opportunity to educate Fitz and make sure he understands the high standards that we have established within our program."

Toussaint is a junior from Youngstown, Ohio.

This spring has been a sad time in our pet family with Dozer, the senior Lab, being put down, Lacey, our very old cat dying under the pool in the big storm, and then on Monday, Jake, our rescue mutt, having to be put down. Jake had changed from an energetic oldster (12) to an ailing oldster in a short amount of time. Initially we thought it was Lyme disease. Even though he had been vaccinated, it is not foolproof, and we began treating him with antibiotics. The vet found no abnormalities in his blood work, but when he sent us home, he said, "Let's hope it's Lyme. If not, it's probably something worse."

It was something worse. Jake quit eating, he began throwing up, and a second trip to the vet showed he had a huge tumor on his spleen. We asked the vet if we could put Jake in the car as if he was going home, and he?euthanized?him there. He died with his head on my ?husband's lap. ?Jake's death left a huge hole in the family and my heart. He'd been a challenging rescue, but he'd also been my shadow. Fang, aka princess Chihuahua, was left with no dog buddies, and I knew I better find another dog to share our lives with before school started and we had less time.

Meet Ziggy. Part bat (check out his ears in the photo below), part mini-pin, part Chihuahua. He came from Caring for Creatures, a fabulous rescue organization that plucks dogs and cats from high-kill shelters before they are put down. Ziggy's ?time was up. He is only one-year-old, he was at CFC for six weeks, and at least a month at the shelter where he came in as a stray, so I can't imagine what his brief life has been like. Fang and I met him at CFC (above) and although I knew Ziggy would be challenging because he was shy and afraid of men, we brought him home.

It's been four days, and I've learned quickly how to be leader of the pack to help reassure Ziggy that he is safe. Here he is resting after his fifth walk (and it's only lunchtime!) Fortunately, he's smart and learning quickly. Challenges are house-training--I haven't picked up on his "I need to go" cues--despite all the walks, and 'stranger' issues. He's super-sensitive to sounds and sights. I have no idea how he coped at the busy, noisy shelters. ?But I am learning what he needs, and he's learning all the rules that I (leader of the pack) have set down, Fang loves playing with him (growls added when he gets too rough), he loves my daughter, and he and my husband are slowly bonding.

Now if he can just find that CAT.

If anyone has a mini-pin, please send ANY suggestions on training. I have read they can be a handful. Ziggy seems to have enough of something "else" in him that he is eager to please, so my fingers are crossed. I do get the feeling he can ?never be allowed off-leash (Fang, aka princess, never has to be on a leash so I have been spoiled.). If he spots something moving, he wants to be after it in a flash.

It took me a long time, but I finally got the school room looking the way it should. We moved in six months ago and the school room/family room/dining room was the last one to be finished. Being on the spectrum, C needs a lot of routine, schedule and organization. It was tough homeschooling him with all of stuff being in such disarray.
Welcome to our homeschool world!





This is the bookcase where I keep the curriculum, books that I reference, teaching games, flash cards, software and sentence cards. I keep magazine files at the bottom for each subject to hold smaller items such as items that I want to copy or magazines, thin books, etc... In this bookcase I store the non-fiction books, readers and fiction books. We keep our world map here on the wall for marking as we travel along with Galloping the Globe and next to the bookcase I have hanging file folders to hold my weekly files 1-36 (more on that later). The credenza is next to our little bookcase and I store a lot in here. Science kits, craft supplies, extra school supplies, paper, folders, etc. On top I keep books for our geography study and the globe. I have baskets of books based on our units of study for easy access. Here is my action area and where most of our schooling takes place. Directly across from the desk is a large dining room table where we do our school work. I found the most adorable calendar and trim set from Trend at the local teacher's store. Personally, I don't laminate, but I just have one student and we get tired of the theme after one year. We got our sentence chart from Target for $1. I bought a few of them and use them in quite a few places throughout the house. Over the printer, I have a clipboard hanging where I keep library lists so that I know which books are due when. It has really helped keep down our overdue fines! ;) On top of my desk, I keep a hanging file box where I keep all of my teacher's manual in use. This way, all I have to do is pull out each one as we need it and then I just slip it back in the box after I am done. No more searching for manuals before a lesson! Next to the desk are C's workboxes. We really enjoy using these and I have written previously about how I have set them up. I base my set-up on Sue Patrick's book, Sue Patrick's Workbox User's Manual. Above the workboxes is a 3-drawer box where I keep our school supplies. I will write more about my system and what I put in his drawers as soon as I can. I so enjoy organization! As you can see by this wall, I have more charts :) One is to show our daily schedule. I bought two more sentence charts at Target for $1 each and glued them together. The Dollar Tree had the time schedule cards for $1 and I had them laminated so that I could change times if I needed to. The hanging file organizer works great for holding all of our file folder games. I put the games into C's workbox on certain days. My toughest challenge was to find a place to put the chalkboard. We are really short on wall space. So I got creative and put it on top of the dinosaur of a television that sits in the family room. It works. I just move it over to the dining room table when we need it. Behind the chalkboard, I store our morning basket which holds our books and memory work that we use at our morning meeting. I found the cutest little basket at Target in the $1 bin. I feel like we finally have some peace and that we are "home". C is much more happy with school now that there is routine and organization. Things flow so much better. Now if I could just get those lesson plans done...

Prelude to a Catastrophe: "Our Best Judgement of Risk"

The whole point of volcano monitoring is risk.

Well, there?s also the sheer joy of scientific discovery for its own sake ? volcanoes are fascinating in their own right. They?re windows on what goes on inside this planet, they can tell us things about how the earth works in ways no other natural features can, and so we?d study them even if not a single human being would ever be inconvenienced by one. But a volcano like Mount St. Helens threatens to harm the people who built lives near it in quieter times. It presents hazards to homes and businesses, infrastructure and commerce, aviation and recreation, and it puts lives in mortal jeopardy. It can kill those close and seriously inconvenience those who might have believed they?re too far away to worry. So when a volcano like St. Helens wakes up feeling rather indisposed, prudent officials give geologists a call and then provide them with the money, equipment and resources needed to assess the threat.

And you don?t stop just because the volcano falls into a fitful, feverish nap.

The ominous and rapidly-growing bulge aside, there was plenty to keep geologists on their toes during that two and a half week lull beginning in mid-April 1980. The mountain may have stopped exploding, but on April 20th, seismicity hit a two-week high. Steam still vented from the summit, with small bursts at midday on the 22nd showing things were still hot, and two new vents opened by the 23rd, confirming that things weren?t cooling down. Tilt measurements revealed a pattern that told geologists that magma might be putting increased pressure on the mountain, inflating it from within. If you were living in areas close to the volcano, USGS geologist Dwight Crandell told folks via the Columbian, plan for evacuation. Have a route ready.

People depended on the scientists getting it right. They needed information: what was she up to? What was she likely to do next? What were the current and future hazards? Could they give a warning before the big bang came?

Remote monitoring of an active volcano can only tell you so much. Seismometers, tiltmeters, and other tools to assess from a distance can give some indication of what the volcano?s up to, but only so much. So as soon as St. Helens quieted down enough to be relatively safe, geologists took some calculated risks, not knowing for certain what the odds were. They collected samples of the gasses in the steam vents near the summit, looking for the kinds of gasses that could tell them more about magma. Sulfur dioxide levels turned out to be high ? an indication magma was close to the surface. As magma rises, there?s less pressure on it, and gasses come out of solution, escaping through cracks and crevices, forcing vents, and giving scientists a look at what might be going on. Studies of sulfur dioxide emissions and their relation to potential eruptive activity at active volcanoes were pretty new then ? they?d only begun to be closely studied in the 60s and 70s, but scientists had already noticed that increased levels of SO2 preceded eruptions at other active volcanoes such as Etna and Asama. If St. Helens followed the same program, SO2 might be one of the critical indicators things were about to blow.

So David Johnston, who was one of the USGS experts in volcanic gasses, grabbed some ash samples from the summit crater on April 23rd. Fumaroles deposited films of chemicals on the ash grains: they could be leached, and studied, and a little more about what St. Helens was up to discovered. That was a risk. The volcano had only stopped exploding a few days before: it could resume at any time, and climbing around by the crater had to be a bit nerve-wracking, even with helicopter support.

But David Johnston was a dedicated geologist who knew that more samples collected as close to the scene of the action as possible would give vital information, and so he climbed down in to the crater on April 30th to sample the brand-new crater lake.

Explosions, avalanches, rock falls, earthquakes, sudden bursts of steam, poisonous gasses, probably about a billion other hazards I haven?t thought of: these are the things geologists will risk to understand a volcano. They do it for love of science, and they do it to save lives. Keep that in mind next time you?re out for a drink, and raise a glass their way.

While Dr. Johnston risked his life in the maw of the mountain, Dwight Crandell discussed matters with the USFS, who, under pressure from folks who were being kept from homes and jobs by closures on the mountain, and in light of the lull, were considering opening bits for restricted use. Dr. Crandell painted them a rather stark picture of risk. That bulging north flank could send avalanches plunging into Spirit Lake or across the North Fork Toutle River, causing sudden floods people couldn?t outrace.

The Forsyth Glacier, he said on April 25th, was ?humped up into one big black rock mass.? Jiggle it with one big earthquake or steam blast, and it would go careening down the slopes at 180 miles (290km) an hour. Two minutes later, the whole mass would plunge into Spirit Lake. ?There will be no way to warn people,? Dr. Crandell said. ?If they are in the path, they won?t be able to get out of the way.? And with the area flooded and Spirit Lake Highway blocked by avalanche debris, any survivors would be stuck.

This was serious stuff. Any notion of easing restrictions needed to be considered carefully, and due caution employed.

New cracks appeared in the bulge on April 27th. On April 29th, the terrible risk it posed caused officials to ask Governor Dixie Lee Ray to close more of the mountain. Their plan sketched two distinct areas: a Red Zone ranging from 3-7 miles (5-11km), which would allow no public access at all, and a Blue Zone, where a few authorized civilians could, with special permission, gain access for work during daylight hours. Gov. Ray acceded to their request the next day.

On May 1st, geologists watched a survey target on the north flank zoom out two feet in less than twelve hours.

A new observation post was set up at Coldwater II, five miles north of the summit. Geologists staffed it round the clock, with only a small travel trailer for comfort. From there, with the time-lapse cameras and monitoring equipment, they could watch the mountain change and be there to capture its further explosive antics, should they happen.

With enough dedication and care, you too can stay fit as you age. Rather than time making fools of us, a more accurate adage of aging may be ?if you don?t use it, you lose it.? To keep your physical abilities regardless of age, try implementing some of these tips.

  • Lift weights. Muscle means strength, but this amounts to more than just picking up heavy objects. The more muscle you have, the stronger your overall body composition will be. Your bone density will increase to fight off the troubling bone-related injuries that many aging people may be familiar with, while strength and resistance training can also do wonders for your metabolism. Try beginning with three days a week of full-body strength training, focusing on major muscle groups in the chest, back, shoulders, arms, abs and legs. A good starting point may be three sets of eight to 12 reps, but if this makes you feel excessively sore or exhausted you may want to decrease the weight or frequency of your sessions.
  • Stay loose. Tight muscles and a reduced range of motion can often spell disaster for aging athletes, creating a common source of injury and loss of balance. Because of this, retaining your flexibility is one of the most important factors in keeping yourself physically fit. Try incorporating dynamic stretches into your workout, which improve your flexibility while also warming you up for more athletic activities. You can also incorporate foam rolling exercises or massage to improve your flexibility.
  • Eat right. Nutrition is a huge factor in any athlete?s performance, but may be most important for aging athletes. Keeping your energy levels high and your recovery times short will take a careful balance of proteins, carbohydrates and nutritious fruits and veggies. Age and lots of exercise can also come with nutritional deficiencies, so it?s important to make sure you?re getting plenty of all essential nutrients. Deficiencies in vitamin B12, vitamin D, calcium and folate are especially common, so talk to your doctor about the possibility of taking supplements to keep as healthy as possible.

Age may slow us down, but it doesn?t have to bring your fitness to a standstill. With anti-aging treatments and careful dedication to a healthy lifestyle, you too can stay fit and strong as you age.

Nexus Q no longer in stock on Google Play, 'shipping in 2-3 weeks'

Google's "social media streamer," the Nexus Q, looked to be approaching launch just a few days ago, with its Google Play Store listing being updated to "in stock", and apparently shipping in 3-5 days.  Well, either the initial stock has entirely sold out, or a snag has been hit somewhere alone the way, as the Q has returned to its previous status of "ships soon," with the glowing multimedia orbs apparently expected to be ready to go in 2-3 weeks.

We ordered a few Nexus Q's to give away right as the device was announced, and none of our orders have shipped so far. If you've placed a Nexus Q order, let us know whether yours has been dispatched down in the comments.

A Thousand Days of Summer ? This is your real mother speaking?

With the end of summer vacation near and the start of school just around the corner, I?m taking stock of how I?ve spent my time these past few months. And as usual, I?ve fallen short of my expectations. The summer seemed to fly by in a haze of doctor appointments, scouting activities, campouts and trips here and there. The boys have been busy with scouting and summer jobs, with the one finishing up a correspondence math course. My oldest was busy finishing up her first year of college (she?s on the Winter/Spring tracks at BYU-Idaho, going from the first of January to the middle of July). Then there is my greatest source of guilt, my youngest. None of my big plans with her have materialized, as of yet. Not that they were that big to begin with. I thought maybe we would do a lot of cooking together, bake bread, compile a recipe book for her?maybe get in some sewing practice. But it hasn?t panned out that way, unfortunately. To make matters worse, we decided not to do swimming this summer. The trip into Albuquerque and back can cost anywhere from ten to thirteen dollars a day, depending on the price of gas, and it was one of those things, among many things, we have had to let go in these years of ?Hope and Change?.? All I can say is that I hope they change soon.

To be honest, besides her daily jobs, riding her bike, the friends she has over to play and the occasional book I see lying around, I?m not sure what my youngest child has been doing all summer! And maybe there?s a part of me that really doesn?t want to know, i.e. feel worse than I already do! I know how it goes when you?re the youngest. I was the youngest myself. You just learn to entertain yourself when everyone else is busy.

The summer?hasn?t?been a complete loss, however. We?ve gone some fun places and done a lot of fun things: tubing the river at Villanueva a couple of times, exploring the ruins at Mesa Verde and the geysers and falls at Yellowstone. We?ve traveled through some beautiful country, gone swimming, went to a chuck wagon dinner and show, as well as the melodrama/musical, Annie Get Your Gun. We spent holidays and birthdays in the company of good friends. We reconnected with our loved ones that live far away. Maybe it?wasn?t?jam packed every day and there was the monotony of chores to do, but it wasn?t half bad.

Now I?m looking ahead to those days when the kids are in school. It?s going to be strange having whole days to myself after spending all my time with my kids. I haven?t done any writing to speak of this whole summer and?I?ve?mostly neglected this blog. But there is a time and a season for everything, and this fall might be the season for writing.

Recently I visited a blog called Onethousandsingledays@wordpress.com. It chronicles the commitment of this blogger to forego relationships with men (she?s single, of course- though many a married woman might occasionally day dream about doing that!) and all that entails, to focus on a thousand days of self-reflection, self-exploration, self-development and writing. I was impressed. Could I embark on a commitment to a thousand days of writing? A hundred might be more my speed! Maybe ten would be a reasonable place to start? I?m notorious for being consistently inconsistent. Still, I?m giving it serious consideration

?Writing is 90 percent procrastination: reading magazines, eating cereal out of the box, watching infomercials.? Paul Rudnick says? and he is so right! When I get out of the ?writing groove?, it?s really hard for me to get back in it. That?s not because I don?t have anything to write about- I?m always working on something in my head (I have stacks of notes- on napkins, newspaper clippings, etc., to prove it) but because it requires discipline. (I blame my lack of and dislike of discipline on being the youngest!)

Inspired by Onethousandsingledays, I got up this morning before any of my kids and spent some time working on an essay and a short story about a pair of red shoes (ya, I know it?s probably already been done?) just cursory notes and ideas scribbled on sheets of white paper, pages that I will add to the pile of other notes and scribbles on my bookshelves and my desk. But it?s a start. I haven?t quite committed in my mind to the thousand days, but I?m practicing. There?s still children to take care of for the next couple of weeks; wisdom teeth removal to deal with, braces to come off, dentist and eye doctor visits, service projects, a back packing trip?the list goes on and on. I?m thinking, though, that August 17th might be the first day of my own thousand day quest. Wish me luck!
